Intoxicated Man Received Additional Charges of Resisting Arrest and Harrassment on a Public Servant in Kirbyville

KIRBYVILLE, TX-

On Friday, July 11th at 8:25 pm., Kirbyville Police Officer Richard Going was dispatched to Jenny's Fried Chicken located at 901 South Margaret Avenue in Kirbyville. The call was regarding a male subject in the parking lot who was reportedly beating on the caller's vehicle.


Going said that when he arrived, he spoke with the complainant, Javier Rodriguez who was standing on the loading dock to the building. Rodriguez indicated to Going the location of his vehicle which is a red Ford F-150 in the parking lot. Going said that he then saw Estin Perez, on the passenger side of the truck, leaning against the truck and beating on the window of the front passenger side door.


As Going approached Perez, he continued to hit on the window and appeared to be talking to someone inside the vehicle, however, the vehicle was empty. Going stated that Perez's speech appeared to be slurred, and he was stumbling when he attempted to get the man to talk to him. Going said that he just stood there and stared at him.


Going said, "I asked him several times what was going on and he finally replied by saying for me to 'go ahead and take him because that's what I was going to do'." Going then asked Perez if he had been drinking and he admitted that he had been. At this point, Perez was taken into custody on the charge of public intoxication.


According to the arrest affidavit, once Perez was placed in wrist restraints, he began to resist arrest. Perez refused to get into the back seat of the patrol car after being instructed to do so several times. Going warned Perez that he would use his drive-stun on him if he did not get into the vehicle. Going added, "I then pulled my Tazer and activated it without making contact in hopes he would get into the vehicle. However, Perez still refused." That is when the Officer applied a drive-stun to Perez's right leg twice in order to get him into the vehicle.


Once Perez was in the vehicle and heading towards the Jasper County Jail, Going said, "Perez began to yell and cuss me. He stated that he would break out of the handcuffs. While en route to the jail, Perez leaned up in the seat and began spitting on me and in my general direction. I instructed him to sit back and stop spitting at me several times, but Perez continued his actions."


Going arranged to meet with Jasper County Deputy Noel approximately half way between Kirbyville and Jasper and transferred Perez to Deputy Noel's vehicle because it has a seat divider.


Going followed Deputy Noel to the Jasper County Jail Perez was turned over to jail staff.


Perez was charged with Public Intoxication, Resisting Arrest with a 2,000 bond, and Harassment of Public Servant with an additional 10,000 bond.
