Texas Department of State Health Services rules on Cottage Law Operators

JASPER — The Jasper-Newton County Public Health District issued a notice today reminding Cottage Law operators of regulations regarding self-service or “honor stand” sales.

According to the Texas Department of State Health Services (DSHS), cottage food products must be packaged, labeled, and delivered directly to the consumer at the point of sale. Prepaid orders may be left for pickup by prior arrangement, but unpurchased foods cannot be displayed in unattended self-service markets or “honor stands.”
The DSHS clarified that “foods must be delivered by the cottage food production operator upon receiving an order.” The ruling took effect Sept. 3, 2025.
